A Fulton County woman, 53 year old KIMBERLY ANN MARTIN of Gepp, was arrested Thursday evening, November 21st, by the Sheriff's Office on felony drug charges following a vehicle stop for an equipment violation.
At approximately 8:26 PM, Sheriff's Corporal Craig Gates was on State Highway 126 S, also known as Buford Road, when he observed a vehicle travelling north bound with a headlamp burned out. He conducted a traffic stop because of the equipment violation. The man driving the vehicle, 39 year old TIMOTHY LIVELY of rural Mountain Home, was found to have a suspended driver license. KIMBERLY MARTIN was a passenger in this vehicle, which she stated belonged to her. It was determined that MARTIN was on probation with Arkansas Community Corrections with a search waiver on file, as was the male driver.
A subsequent search of the vehicle was conducted. During this search various narcotics were found, as well as various articles of drug paraphernalia. These included approximately 3.5 grams of methamphetamine, hydrocodone pills, oxycodone pills, clonazepam pills, alprazolam pills, multiple smoking pipes with methamphetamine residue, and digital scales. All of this contraband was seized and taken into evidence.
KIMBERLY ANN MARTIN was arrested and taken to the Baxter County Detention Center where she was incarcerated on charges of:
Possession of Controlled Substance (Methamphetamine) - Felony
Possession of Drug Paraphernalia (2 counts) - Felonies
Possession of Drug Paraphernalia (3 counts) - Misdemeanors
Possession of Schedule II Controlled Substance - Felony
Possession of Schedule II Controlled substance with Purpose to Deliver - Felony
MARTIN is being held in custody in lieu of $10,000 bond on these charges. She will appear before the Baxter County Circuit Court to answer on December 5th. TIMOTHY LIVELY was cited for Driving While License Suspended and Defective Equipment. He will appear in District Court on those charges at a later date.
