TWO MEN ARRESTED ON MULTIPLE CHARGES FOLLOWING DRUG USE COMPLAINT

Two Baxter County men have been arrested and jailed on a multitude of burglary, theft, and drug charges follow a complaint call and follow-up investigation. On the morning of Tuesday, December 11th, Sheriff’s Sergeant Andy Bower and Corporal Edward Elliott responded to an address on Old Military Road in rural Baxter County in response to a complaint call indicating drug use was taking place inside a vehicle parked at a private residence.
Upon arrival at this location, deputies found a white pickup truck sitting in the driveway with two doors open. Corporal Elliott observed a man stumbling around behind a trailer next to this residence and made contact with him. Corporal Elliott observed this man throw an orange syringe and some other item with his left hand. This person, later identified as 27 year old CODY GENE GUNTER, was taken into custody by Corporal Elliott. The syringe was recovered, and it was found to contain suspected controlled substance. While conducting a search of CODY GUNTER, Corporal Elliott found a plastic container in the pocket of a jacket. This container held a baggie of a white substance and some pills. The pills were identified as Carisoprodol. Marijuana was also found inside a cigarette box. These items were seized and taken into evidence. Later, 16 additional pills identified as Oxycodone were found on GUNTER’s person.
Sheriff’s Investigator Trey Edings was called to assist with the incident. Deputies learned a second occupant of this vehicle had fled on foot before officers arrived. This person, identified as 29 year old DAVID ALLEN LEWIS, was determined to be the owner of the pickup truck. Deputies observed suspected controlled substance and drug paraphernalia inside the vehicle. A search of the vehicle was then conducted. During the search, additional syringes and other paraphernalia were found and seized, together with one Morphine pill and a substance believed to be Roxicet. Later in the afternoon, DAVID ALLEN LEWIS was located and taken into custody by Sheriff’s Investigators.
Following the morning arrest of GUNTER on these drug charges, both he and LEWIS were developed as suspects in a Residential Burglary that had been reported to the Sheriff’s Office on December 10, 2012 on Baxter CR 604. During this burglary, a Hewlett-Packard laptop computer valued at $700.00 was stolen. Also stolen were a Remington shotgun valued at $350.00, a Marlin .22 magnum rifle and scope valued at $250.00, and a Remington .22 rifle with scope valued at $250.00. There was also a quantity of jewelry stolen consisting of rings, earrings, watches, bracelets, and other items valued collectively at $10,000.00. GUNTER assisted Sheriff’s Lieutenant Terry Johnson and Sergeant Brad Hurst in recovering some of these items, which had been hidden or tossed out of a vehicle in the Shipps Ferry area of Baxter County.
CODY GENE GUNTER is being held in the Baxter County Detention Center after being booked in at 10:57 AM on December 11th on charges of:
Possession of Controlled Substance (2 counts) – Class D Felonies
Possession of Drug Paraphernalia – Class A Misdemeanor
Residential Burglary – Class B Felony
Theft of Property – Class C Felony
Theft of Property (3 counts) – Class D Felonies
GUNTER had an initial bond of $15,000 pending an appearance set for today in Baxter County Circuit Court.
DAVID ALLEN LEWIS is being held in the Baxter County Detention Center after being booked in at 7:49 PM on December 11th on charges of:
Possession of Schedule II Controlled Substance (Oxycodone) – Class D Felony
Possession of Schedule II Controlled Substance (Morphine) – Class D Felony
Possession of Drug Paraphernalia – Class A Misdemeanor
Residential Burglary – Class B Felony
Theft of Property – Class C Felony
Theft of Property (3 counts) – Class D Felonies
Possession of Firearm by Certain Persons (Convicted Felon) – Class D Felony
Non-Payment of Fines – District Court – Misdemeanor Warrant
LEWIS had an initial bond of $25,000 pending an appearance set for today in Baxter County Circuit Court, as well as a $270 bond on the misdemeanor non-payment warrant.
A third person is being sought in connection with the burglary and disposition of some of the stolen articles.
